 What is the process for an “uncontested divorce”?

 
To get a divorce after the requisite one year of separation, you must file a Complaint and Civil Summons with the court, generally in the county you reside.   Your spouse will have to be served with the Complaint and Civil Summons by sheriff or by certified mail.  Your spouse has 30 days from the date he or she is served to file an Answer to the Complaint.  A divorce hearing is then calendared with the court typically once those 30 days have expired.  Your attorney should be able to obtain a judge’s signature on your Judgment of Absolute Divorce without you having to appear at the hearing.  This whole process should take no longer than two months, depending on how difficult it is to have your spouse served.
